The conventional wisdom seems to be that Roberts will get confirmed, after some tough questioning by the Democrats like Schumer, Leahy, Durbin, and Kennedy on the Judiciary Committee. There will probably be no filibuster. Bush will get his wish to have a new justice sitting on the bench in time for the first Monday in October.
Okay, so the next question will be whom to appoint to fill Roberts' seat on the Circuit Court. I say the President should renominate Miguel Estrada. The only way that the Democrats were able to filibuster Estrada was by complaining that they hadn't seen papers from his time in Bill Clinton's Solicitor General's office. Well, just after they approved John Roberts who served in Republican president's administration in the Solicitor General's and White House Counsel's office. (In fact, how did they let Roberts through in the first place to the Circuit Court without standing on their demands to see his papers? Different strokes for white nominees than Hispanic nominees, perhaps.)
With a bigger Republican majority, the history of Roberts' nomination to the Supreme Court, the deal by the Gang of 14 that said they'd only filibuster based on extraordinary circumstances, Estrada should be confirmed. There would be lots of publicity since this could be the first big test of the Gang of 14's deal for an appellate nominee and because of the publicity of renominating Estrada. So, let's say that Estrada finally gets approved to the Circuit Court. He'd have a year or so there before Rehnquist might step down.
Bush can elevate Roberts, whom everyone agrees is a very nice guy with the ability to get along with people from all ideological backgrounds. And Bush can then nominate Estrada and get the historic Hispanic nomination that he purportedly desires. posted by Betsy Newmark permalink 8:55 AM
